Judge Declines To Set Aside Plea Deal For Man Who Shot At Girlfriend, Her Companion

Criminal Court Judge Tom Greenholtz on Friday declined to set aside the plea deal for Michael W. Shavers.

 

At an earlier hearing, one of the victims in the case and her mother had expressed their discontent with the plea deal.

The judge delayed acceptance of the plea while getting a probation report on Shavers' background and his likelihood of reoffending.

 

The report said Shavers was not a high risk for carrying out another crime.

 

The deal is for a 10-year sentence of home confinement 24 hours per day with a GPS monitor.

 

Prosecutor Cameron Williams said earlier that since Shavers had helped in the prosecution of the Lookout Valley murders case that he might be at risk in prison.

 

In the incident in 2015, Police said Ashley Harris, then 22, and Joshua Maples, then 25, were exiting the parking lot at 3805 Cummings Highway in their vehicle when Shavers, the ex-boyfriend of Ms. Harris, began shooting at them. 

 

Both victims suffered non-life threatening injuries and were treated at a local hospital. Shavers was afterward apprehended in a cave in Dade County, Ga.

 

Judge Greenholtz said he has set aside plea deals in the past, but he said the judge must find the deal is "patently unreasonable."

 

He also said that in most cases "the judge must stay in his lane" because the district attorney is the one making the decisions on prosecuting cases while considering a number of factors known to the DA.
